In this track I’m thinking again about the law, and in particular, the role of law in relation to human righs. I have what many people might think of as a kind of eccentric position on social rights, which is the subject of today’s track.
On the one hand, I’m sure they exist, and that we should fight for them. On the other, I’m not at all certain that the right people to do the fighting are the lawyers. That what we should do, as many people believe, is invest Supreme Courts and Constitutional Courts with this tremendous power to impose social rights on the rest of us. So it’s a kind of – bit of one, bit of the other – position: a commitment to social rights, but a commitment that does not extend to judicial protection.
So that’s what this track is about, and I look forward to hearing your comments in due course.
